What goes into determining an employee's right to work?

Article author

There are several factors at play when assessing if an employee has the right to work in a country. Each case is unique and depending on the country and level of complexity, this may impact the employee's start date.

Some factors that need to be considered are:

  • Is the person currently on a visa that is tied to their previous employer?
  • Does the person require support for their visa from their future employer?
  • Does the person have a Permanent Residency Visa or are they are still in the process of getting one?
  • Is the person on a short-term or travel visa and seeking work sponsorship?
