China: Paternity Leave Policy

Entitlement offered at provincial level only

Eligibility

  • Employee must be the spouse (husband) of the woman who gave birth. 

Documentation

  • Marriage Certificate
  • Birth Certificate of the child

Start and End of Eligibility

  • The leave is generally required to be taken as a continuous period during the mother's maternity leave.
  • Some province (eg. Shanghai) explicitly allow the leave to be postponed if it includes a national statutory holiday.
