Thing to note

  • The "Medical Treatment Period" (MTP) is the statutory maximum duration during which an employer is legally prohibited from terminating an employee's contract (except in cases of gross misconduct). 
  • This period is cumulative (sick days are added up over a rolling period, not just a calendar year) and depends on the employee's total years of service (across all employers) and tenure at the current employer. 
  • Holidays and rest days are generally included in the MTP calculation
